On December 11, 2026, a federal change to the definition of hemp takes effect. Here is what it means for what you can buy. This is a summary, not legal advice.
What the rule says
The change is in Section 781 of Public Law 119-37. Two parts matter to a shopper.
- Total THC is what counts. The limit covers total THC, which includes THCA (the form in raw hemp flower), not just delta-9 THC.
- The limit is per container. A finished hemp-derived cannabinoid product may hold no more than 0.4 mg of total THC per container.
A container is the package you buy: one bottle, jar, tin or bag. The limit covers the whole package, not one serving. A bottle of 30 servings with 1 mg of THC in each holds 30 mg, well over the limit.

Some details were still open in October 2026. The FDA had not published the list of cannabinoids the law refers to, or defined a container as the law requires. Rules like this often get clarified after they take effect.
When it takes effect
Congress delayed the start. A continuing resolution (H.R. 6500, passed September 1, 2026) moved most of the rule from November 12 to December 11, 2026. Synthetic cannabinoids, the ones the hemp plant does not make on its own, are still restricted from November 12.
These products are on sale until then. The full list is on the last chance page.
Which products it reaches
Products with THC: THC gummies and oils, plus some full spectrum gummies and tinctures where the THC in the whole package adds up to more than 0.4 mg.
We check each product against the limit using the brand's lab report, or the THC per piece on the label times the count.

What stays available
The limit doesn't touch products with no THC:
- THC-free CBD. Broad spectrum and isolate products with no THC.
- Functional mushrooms. Lion's mane and similar products have no cannabinoids at all.
- Topicals. Balms, creams and salves, many with no THC.
Not sure about a product? Check the THC figure on its label and lab report.

State rules can differ
States set their own hemp rules. Some may restrict hemp THC products sooner or differently. Check the rules where you live.
What this means on this site
Products over the limit stay on sale until December 11. On that day they leave the shop. Products with no THC are still available.
